First there is a claim which is brought on behalf of certain relatives of the person who died. Typically, this can include members of the immediate family who have suffered either emotional or financial loss as a result of the death.
A second type of claim is brought on behalf of the person who died. To bring this type of action, an estate needs to be opened on behalf of the deceased person, and typically the claim will involve the suffering that the person who died underwent as a result of the injury that they sustained, and any bills, including medical expenses, which may have resulted in treating the injuries that eventually led to death.
